Terms of Service

These Terms of Service ("Terms") govern your access to and use of Budget Pilot (the
"Service," "we," "us," or "our"). By creating an account, accessing, or using Budget Pilot,
you agree to be bound by these Terms. If you do not agree to these Terms, please do not use
the Service.
1. What Budget Pilot Is
Budget Pilot is a personal and household budgeting and financial tracking tool. It enables
you to organize accounts and transactions — entered manually, imported via file, or
automatically retrieved from your financial institutions through an authorized third-party
account-linking partner (see Section 3) — set budgets, plan debt payoffs, and generate
internal financial statements (such as income statements, balance sheets, and cash flow
statements) from your own data.
IMPORTANT DISCLAIMER — NOT PROFESSIONAL ADVICE: Budget Pilot is a software
tool, not a certified financial planner, certified public accountant (CPA), tax advisor, or
law firm. All calculations, projections, reports, and debt payoff models generated by the
Service are automated outputs based strictly on data you provide, are provided for
informational purposes only, and may contain inaccuracies. They do not constitute formal
tax, legal, accounting, or investment advice. You assume full and sole responsibility for
any financial decisions, budgeting plans, or actions you take based on information obtained
through Budget Pilot.
AI Assistant ("Sterling"): Budget Pilot includes an optional artificial
intelligence assistant powered by third-party large language models. Responses generated by
Sterling are automated, informational outputs based on mathematical algorithms and may
contain factual errors, hallucinated calculations, or inaccurate budgeting categorizations.
Sterling does not provide fiduciary, tax, investment, or certified financial advice. You
agree not to rely solely on Sterling's outputs for consequential financial decisions, and
you agree not to submit prompt injections, reverse-engineering queries, or unlawful data
into the assistant interface.
2. Eligibility
You must be at least 18 years old and possess the legal capacity to form a binding
contract under the laws of the State of Arizona and your jurisdiction to create an account
and use Budget Pilot.
3. Third-Party Financial Aggregation and Plaid
Budget Pilot offers an optional bank-linking feature that automatically retrieves account
balances and transaction history from your financial institutions, instead of requiring you
to enter or import that data by hand. This feature is provided through our third-party
service provider, Plaid Inc. ("Plaid"). By choosing to link a financial account, you agree to
the following:
- Authorization and Agency: You grant Budget Pilot and Plaid the right,
power, and authority to act on your behalf to access, retrieve, and transmit your personal
and financial information (including balances, transaction history, and account details)
from the relevant financial institution.
- Plaid's Own Policies: You agree that your personal and financial
information will be transferred, stored, and processed by Plaid in accordance with the
Plaid End User Privacy Policy.
- No Credential Access: You enter your online banking credentials
directly through Plaid's own secure interface (Plaid Link). Budget Pilot never receives,
views, transmits, or stores your banking usernames, passwords, PINs, or multi-factor
authentication codes.
- Data Accuracy, Continuity & Non-Affiliation: Budget Pilot relies on
data supplied by your financial institutions and by Plaid. We do not warrant that these
data feeds will be uninterrupted, error-free, timely, or complete, and we are not
responsible or liable for sync failures, delayed transaction posting, pending-status
changes, inaccurate balances, or account-access issues occurring at your financial
institution or at Plaid. Budget Pilot is not endorsed by, affiliated with, or sponsored by
any bank, credit union, or other financial institution linked through the Service.
- Not a Consumer Report: Data retrieved via Plaid is used exclusively to
provide household budgeting and financial-tracking features within Budget Pilot. It is not
used, evaluated, or furnished as a "consumer report" under the Fair Credit Reporting Act
(FCRA), and must not be relied upon for creditworthiness, employment, tenant-screening, or
similar eligibility determinations.
- Disconnecting a Linked Account: You may unlink any connected financial
account at any time from within the Service. Doing so revokes Budget Pilot's and Plaid's
access to that account at the institution; it does not retroactively remove transactions
already saved to your Household workspace, which remain until you delete them yourself. You
can also view, manage, or revoke access to your connected institutions directly, at any
time, through the Plaid
Portal. See our Privacy Policy for more detail.
You agree that Plaid is an intended third-party beneficiary of this Section 3, with the
right to enforce its provisions directly against you.
4. Your Account and Household Workspace
- Account Security: You are responsible for maintaining the
confidentiality of your login credentials and are fully responsible for all activities
occurring under your account.
- Household Workspaces: A "Household" is a shared workspace. Any member
who accepts an invite or joins your Household will have full visibility and editing
capabilities for all financial data entered within that workspace, including any account
you link via Plaid — once linked, that account's synced balances and transactions are
visible to every Household member the same as a manually entered one. You are solely
responsible for managing whom you invite into your Household.
- Workspace Administration: The user who initiates and creates a
Household is deemed the primary administrator. In the event of a dispute among Household
members, we reserve the right (but have no obligation) to rely on the directions of the
primary administrator or require separate accounts.
- Accurate Information: You agree to provide true, accurate, and current
information when registering your account.
5. Data Ownership & Limited License
- Your Data: You retain full ownership of all financial records,
transaction histories, notes, and information you submit, paste, upload, or link into
Budget Pilot ("User Data"). We do not claim any proprietary rights over your data.
- License to Operate: You grant us a non-exclusive, worldwide,
royalty-free license to store, process, reformat, and display your User Data strictly as
necessary to provide, maintain, and support the Service for you and your Household.
- Data Integrity: You acknowledge that Budget Pilot performs calculations
based on raw numbers you provide or that are retrieved on your behalf via Plaid; we do not
independently verify, audit, or reconcile your underlying financial records.

6. Subscriptions, Billing, and Payments
- Paid Subscriptions & Renewals: Budget Pilot offers paid
subscription tiers (as well as optional free access or trial periods). If you purchase a
subscription, payment processing is handled by our third-party billing provider, Stripe,
Inc. ("Stripe"). By subscribing, you authorize Budget Pilot and Stripe to automatically
charge your designated payment method on a recurring monthly or annual basis until
canceled.
- Cancellation & Access: You may cancel your subscription at any time
through your in-app billing settings. Cancellation takes effect at the conclusion of your
current billing period; you will retain access to your paid tier features until that period
ends. Unless required by law, subscription payments are non-refundable and we do not
provide prorated refunds for partial billing periods.
- Taxes: Subscription fees do not include applicable state, local, or
federal sales taxes, transaction privilege taxes, or value-added taxes (VAT). You are
responsible for all applicable taxes associated with your purchase, which will be
calculated and collected at checkout based on your billing address.
- Price Adjustments: We reserve the right to modify subscription pricing
at any time. Any price changes will be communicated with reasonable advance notice, allowing
you an opportunity to cancel prior to the new rates taking effect.
7. Acceptable Use Policy
You agree that you will not:
- Use the Service for any unlawful, fraudulent, or malicious purpose.
- Attempt to bypass database row-level security or access another user's or household's
data without authorization.
- Decompile, reverse engineer, disassemble, or attempt to extract the source code of the
Service.
- Upload or store data that infringes upon the privacy, intellectual property, or legal
rights of any third party.
- Interfere with, overload, or disrupt the integrity or performance of the Service,
servers, or infrastructure.
8. Service Availability and Modifications
We strive to maintain high availability and reliability, but we do not guarantee
continuous, uninterrupted, or error-free operation — including of data feeds supplied by
Plaid or your financial institutions. We reserve the right to update, modify, suspend, or
discontinue features of the Service at any time with reasonable notice where practical.
9. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, BUDGET PILOT IS PROVIDED ON AN
"AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. WE
EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE,
INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT
CALCULATIONS, FINANCIAL METRICS, OR PROJECTIONS WILL BE COMPLETELY ACCURATE, SECURE, OR
RELIABLE, NOR DO WE WARRANT THE CONTINUOUS AVAILABILITY, TIMELINESS, OR ACCURACY OF DATA
PROVIDED BY PLAID OR ANY LINKED FINANCIAL INSTITUTION.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- NO CONSEQUENTIAL DAMAGES: IN NO EVENT SHALL BUDGET PILOT, ITS
OPERATOR, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA,
GOODWILL, WORK STOPPAGE, OR FINANCIAL LOSSES ARISING OUT OF OR IN CONNECTION WITH YOUR USE
OF OR INABILITY TO USE THE SERVICE, INCLUDING ANY SYNC FAILURE, DELAY, OR INACCURACY IN
DATA SUPPLIED BY PLAID OR A LINKED FINANCIAL INSTITUTION.
- AGGREGATE MONETARY CAP: OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR
RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE, UNDER ANY LEGAL OR EQUITABLE THEORY
(WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), SHALL NOT EXCEED THE GREATER
OF: (A) THE TOTAL AMOUNT PAID BY YOU TO BUDGET PILOT IN THE TWELVE (12) MONTHS PRECEDING THE
EVENT GIVING RISE TO LIABILITY, OR (B) FIFTY UNITED STATES DOLLARS ($50.00 USD).
11. Indemnification
You agree to defend, indemnify, and hold harmless Budget Pilot, its operator,
contributors, and service providers from and against any claims, liabilities, damages,
judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising
out of or relating to: (a) your violation of these Terms; (b) any User Data you upload,
transmit, or link via a third-party account-linking partner; (c) disputes between members of
your Household; or (d) your violation of any third-party rights or applicable laws.
12. Dispute Resolution, Governing Law & Class Action Waiver
- Governing Law: These Terms and any disputes arising out of or related
to your use of Budget Pilot shall be governed by and construed in accordance with the laws
of the State of Arizona, without regard to its conflict-of-law principles.
- Exclusive Venue: Any legal action, suit, or proceeding arising under or
relating to these Terms shall be instituted exclusively in the state or federal courts
located in Maricopa County, Arizona, and each party irrevocably submits to the personal
jurisdiction of such courts.
- Class Action Waiver: YOU AND BUDGET PILOT AGREE THAT ALL CLAIMS MUST BE
BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED
CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
13. Termination and Account Deletion
You may stop using the Service and request the complete deletion of your account and
associated data at any time by contacting us. We reserve the right to suspend or terminate
your account immediately if you breach these Terms or engage in conduct that poses technical,
security, or legal risk to the Service.
14. Changes to These Terms
We may revise these Terms from time to time. If we make material modifications, we will
update the "Last updated" date at the top and provide reasonable notice through the
application or via email. Your continued use of Budget Pilot following any updates
constitutes acceptance of the revised Terms.
